High Court Rules Against Legal Aid Payment Delays

At MSM Law, we are proud to share that our own Eoghan McKenna played an important role, as Chair of The Law Society Criminal Committee, assisting with a landmark High Court case against the Department of Justice and the Legal Services Agency regarding unreasonable delays in legal aid payments, which has now resulted in a judgment against the government.

The court found that the current average 12-week delay in processing payments is unacceptable and breaches statutory duties.

This ruling is a significant step towards ensuring fair and timely remuneration for legal professionals who provide vital services under the legal aid system.

Prompt payment to solicitors for work completed to assist clients is essential for maintaining the system of access to justice here and the rule of law indeed.
