Mediation and Alternative Dispute Resolution

Alternative Dispute Resolution is a process by which conflicts or disputes can be resolved and is an alternative to court proceedings. It aims to resolve conflict to the mutual satisfaction of all parties through dialogue and communication. The entire process is both informal and strictly confidential helping to mitigate the stress of going through an adversarial court system and avoiding any damaging publicity.

ADR seeks to find practical solutions to conflicts and is often quicker, less stressful and less costly than other proceedings.

Mediation is a form of ADR and involves the resolution of a dispute between two or more parties. The Mediator, as a neutral third party, facilitates the parties in negotiating a mutually agreeable settlement which can be enforced by law if required.

The mediation process can be tailored to suit the needs of the individual dispute. The role of the mediator can be conciliatory or proactive whereby suggestions are made for possible solutions.
